The new scsi.device is boot resident, as in when setpatch applies the
rom update the latest scsi.device is loaded into memory - unless something
like the SKIP ROM UPDATES command is used. If you aren't getting
the latest version 43.xx then I think you should check the startup-sequence to make sure that no commands a trailing the setpatch command which could be stopping the new scsi-device. Also check the NSDPatch.cfg file to make sure that your controller isn't commented out.
