LICENSE AGREEMENT
Use of this software is regulated by the following license agreement.
Read this agreement before installing or using the software as this
constitutes implicit acceptance of the terms and conditions in this
license agreement.
Eyelight's PowerPack license Agreement
This License agreement is entered into by and between Eyelight
di Massimiliano Marras, Via del Serafico, 64 00142 Roma Italy
("Eyelight") and you, the customer of this package ("Licensee").
This license agreement regulates the terms and conditions under
which the Licensee is entitled to use the PowerPack data, software,
documentation, dongle (if provided) and additional package
components ("PowerPack").
1. PowerPack License
Subject to Licensee's compliance with the terms and conditions
of this Agreement, Eyelight grants to Licensee the right to use
for commercial and non-commercial purposes the collection of data found on the PowerPack on 1
computer at a time. The Licensee is allowed to redistributed free of charge derived works that incorporate
data from the PowerPack provided that the derived work is a substantially original creation and that the
PowerPack data as presented in the derived work can not be extracted or used by third parties.
2. Restriction of rights
The Licensee knows and agrees to not disclose, publish,
distribute, PowerPack either in full or in part except as noted above. The Licensee knows and agrees not to
disassemble, reverse engineer, modify or otherwise alter
PowerPack even only for personal use or study purposes.
Inter-operability informations are easily and readily available
from Eyelight. The Licensee knows and agrees to the fact that
even if the country where he lives in does not regulate
unauthorized duplication and distribution of copyrighted
software, this agreement binds the Licensee to abide to its
terms and conditions and constitutes the basis for civil and
penal prosecution to the fullest extents of law.
3. Non trasferable license
The Licensee knows and agrees on the fact that this license is non-trasferable to third parties, either in full or in part.
4. Termination of license
The Licensee knows and agrees to the fact that Eyelight reserves
the right to terminate the license at any time and for whatever
reason, without any explaination, and to refuse to provide to
the Licensee any kind of product improvement, upgrade, update or
modification.
5. No warranty
The Licensee knows and agrees on the fact that TORNADO3D IS
PROVIDED "AS IS" AND EYELIGHT DOES NOT OFFER ANY WARRANTY
REGARDING THE CONTENTS OF THE DOCUMENTATION, THE SOFTWARE OR
ANYTHING ELSE INCLUDED IN THE PACKAGE OR OBTAINED AT A LATER
TIME. ABSOLUTELY NO WARRANTY, EITHER EXPRESSED OR IMPLIED, IS
GIVEN REGARDING POWERPACK, NOT EVEN FOR ITS MERCHANTABILITY OR
ITS FITNESS FOR A PARTICULAR PURPOSE. KNOWING THIS, THE USER
INSTALLS AND USE THE PACKAGE AT ITS OWN RISK AS AN ACT OF FREE
WILL, HEREBY FREEING EYELIGHT FROM ANY RESPONSABILITY. IN
PARTICULAR EYELIGHT CAN NOT BE HELD RESPONSABLE FOR DAMAGES TO
PERSONS OR THINGS DUE TO THE PROPER OR IMPROPER USE OF POWERPACK.
6. Limitation of liability and governing law
UNDER NO CIRCUMSTANCES EYELIGHT WILL BE RESPONSABLE FOR MORE
THAN EYELIGHT'S SELLING PRICE OF ONE (1) PACKAGE. ANY LITIGATION
WILL BE HELD IN THE COURTS OF ROME, ITALY.
